Summary

Beginning January 1, 2010, strikes the 5-year sunset provision in the statute, permitting ongoing reimbursement for all Medicare Part B services furnished by certain Indian hospitals and clinics.

CMS in the summer of 2010 issued a notice (followed by a transmittal) containing the final wage indices, hospital reclassifications, payment rates, impacts, and other related tables effective for the FY 2010 hospital IPPS and RY 2010 LTCH PPS.  The notice clarified that, pursuant to this section, hospitals operated by the IHS, Indian Tribes, or Tribal Organizations will continue to be paid for Part B services under an all-inclusive rate for hospital outpatient services rather than under the OPPS.

Of note, in a Feb. 3 blog post, SAMHSA leaders detail the role of the ACA in enhancing access to behavioral health services to the American Indian/Alaska Native (AI/AN) community.

(a) REIMBURSEMENT FOR ALL MEDICARE PART B SERVICES FURNISHED BY CERTAIN INDIAN HOSPITALS AND CLINICS.—Section 1880(e)(1)(A) of the Social Security Act (42 U.S.C. 1395qq(e)(1)(A)) is amended by striking ‘‘during the 5-year period beginning on’’ and inserting ‘‘on or after’’. (b) EFFECTIVE DATE.—The amendments made by this section shall apply to items or services furnished on or after January 1, 2010
