Effective March 23, 2010, extends medical malpractice coverage to an officer, governing board member, employee, or contractor of a free clinic.
Prior to January 2013, this provision was effectuated via an information collection request notice published by HRSA in May 2011, followed by another notice in August 2011. On August 14, HRSA posted a revision of an existing information collectionpertaining to the Federal Tort Claims Act Free Clinic Application. In this revised informational undertaking, HRSA outlines revisions to the application forms to “reflect changes to eligible personnel [pursuant to this section of the ACA], which extended FTCA medical malpractice liability protection to free clinic board members, officers, employees, and contractors.”
SEC. 10608. EXTENSION OF MEDICAL MALPRACTICE COVERAGE TO FREE CLINICS. (a) IN GENERAL.—Section 224(o)(1) of the Public Health Service Act (42 U.S.C. 233(o)(1)) is amended by inserting after ‘‘to an individual’’ the following: ‘‘, or an officer, governing board member, employee, or contractor of a free clinic shall in providing services for the free clinic,’’. (b) EFFECTIVE DATE.—The amendment made by this section shall take effect on the date of enactment of this Act and apply to any act or omission which occurs on or after that date.
