This provision was most recently extended by section 608 of the American Taxpayer Relief Act of 2012 (ATRA). For more information about these plans, see CMS’s webpage devoted to this issue.

P.L. 113-93, the Protecting Access to Medicare Act of 2014 (i.e., the “doc fix”), which was signed into law on April 1, contains a provision at section at 108 of the law that extends the authority of Medicare cost contract arrangements through December 31, 2016.

SEC. 3206. EXTENSION OF REASONABLE COST CONTRACTS. Section 1876(h)(5)(C)(ii) of the Social Security Act (42 U.S.C. 1395mm(h)(5)(C)(ii)) is amended, in the matter preceding subclause (I), by striking ‘‘January 1, 2010’’ and inserting ‘‘January 1, 2013’’.
