Implementation Status
Statutory Text

Summary

Directs the Secretary of HHS to establish a demonstration project – that operates from January 1, 2012 through December 31, 2016 – in which participating pediatric medical providers would be rewarded as recognized Medicaid ACOs for meeting specified requirements.  Among other requirements, directs participating states to, in consultation with HHS, establish an annual minimum savings level for items and services under Medicaid and CHIP that must be reached in order to receive an incentive payment (as determined by the Secretary).  Authorizes to be appropriated (but does not delineate a separate Congressional appropriation) such sums as may be necessary to carry out the demonstration.

Prior to January 2013, CMS had yet to issue guidance pursuant to this provision, though issued related guidance on Medicare ACOs (Pioneer ACOs – see here – and Medicare Shared Savings Program (MSSP) – see here – as well as announced other related coordinated care/integration-focused efforts (e.g. State Innovation Models (SIM) initiative).

On March 7, HHS, Labor and Treasury issued a Request for Information soliciting public comments on the ACA provider non-discrimination provision. The RFI cites a congressional directive, citing concerns with the agencies’ previously issued FAQ, in seeking broad comments by June 10, 2014 on the provision’s implementation.
