Prior to January 2013, CMS in December of 2010 issued an information collection request regarding the Medicaid SPA preprint for use when states implement this provision of the law. CMS also addressed the implementation of this provision in a SMD letter as well as an informational bulletin.

On February 24, 2014, CMS released a November 2013 Medicaid Managed Care Encounter Data Toolkit prepared by Mathematica that addresses certain provisions of the ACA, including sections 6402 and 6505.

SEC. 6505. PROHIBITION ON PAYMENTS TO INSTITUTIONS OR ENTITIES LOCATED OUTSIDE OF THE UNITED STATES. Section 1902(a) of the Social Security Act (42 U.S.C. 1396b(a)), as amended by section 6503, is amended by inserting after paragraph (79) the following new paragraph: ‘‘(80) provide that the State shall not provide any payments for items or services provided under the State plan or under a waiver to any financial institution or entity located outside of the United States;’’.
