SEC. 2102. TECHNICAL CORRECTIONS. (a) CHIPRA.—Effective as if included in the enactment of the Children’s Health Insurance Program Reauthorization Act of 2009 (Public Law 111–3) (in this section referred to as ‘‘CHIPRA’’): (1) Section 2104(m) of the Social Security Act, as added by section 102 of CHIPRA, is amended— (A) by redesignating paragraph (7) as paragraph (8); and (B) by inserting after paragraph (6), the following: ‘‘(7) ADJUSTMENT OF FISCAL YEAR 2010 ALLOTMENTS TO ACCOUNT FOR CHANGES IN PROJECTED SPENDING FOR CERTAIN PREVIOUSLY APPROVED EXPANSION PROGRAMS.—For purposes of recalculating the fiscal year 2010 allotment, in the case of one of the 50 States or the District of Columbia that has an approved State plan amendment effective January 1, 2006, to provide child health assistance through the provision of benefits under the State plan under title XIX for children from birth through age 5 whose family income does not exceed 200 percent of the poverty line, the Secretary shall increase the allotment by an amount that would be equal to the Federal share of expenditures that would have been claimed at the enhanced FMAP rate rather than the Federal medical assistance percentage matching rate for such population.’’. [Additional amendments to section 2104(m) of the SSA made by section 10203(d)(2), p. 849] (2) Section 605 of CHIPRA is amended by striking ‘‘legal residents’’ and insert ‘‘lawfully residing in the United States’’. (3) Subclauses (I) and (II) of paragraph (3)(C)(i) of section 2105(a) of the Social Security Act (42 U.S.C. 1397ee(a)(3)(ii)), as added by section 104 of CHIPRA, are each amended by striking ‘‘, respectively’’. (4) Section 2105(a)(3)(E)(ii) of the Social Security Act (42 U.S.C. 1397ee(a)(3)(E)(ii)), as added by section 104 of CHIPRA, is amended by striking subclause (IV). (5) Section 2105(c)(9)(B) of the Social Security Act (42 U.S.C. 1397e(c)(9)(B)), as added by section 211(c)(1) of CHIPRA, is amended by striking ‘‘section 1903(a)(3)(F)’’ and inserting ‘‘section 1903(a)(3)(G)’’. (6) Section 2109(b)(2)(B) of the Social Security Act (42 U.S.C. 1397ii(b)(2)(B)), as added by section 602 of CHIPRA, is amended by striking ‘‘the child population growth factor under section 2104(m)(5)(B)’’ and inserting ‘‘a high-performing State under section 2111(b)(3)(B)’’. (7) Section 2110(c)(9)(B)(v) of the Social Security Act (42 U.S.C. 1397jj(c)(9)(B)(v)), as added by section 505(b) of CHIPRA, is amended by striking ‘‘school or school system’’ and inserting ‘‘local educational agency (as defined under section 9101 of the Elementary and Secondary Education Act of 1965’’. (8) Section 211(a)(1)(B) of CHIPRA is amended— (A) by striking ‘‘is amended’’ and all that follows through ‘‘adding’’ and inserting ‘‘is amended by adding’’; and (B) by redesignating the new subparagraph to be added by such section to section 1903(a)(3) of the Social Security Act as a new subparagraph (H). (b) ARRA.—Effective as if included in the enactment of section 5006(a) of division B of the American Recovery and Reinvestment Act of 2009 (Public Law 111–5), the second sentence of section 1916A(a)(1) of the Social Security Act (42 U.S.C. 1396o–1(a)(1)) is amended by striking ‘‘or (i)’’ and inserting ‘‘, (i), or (j)’’.
